Terms of Use

Effective October 12, 2026

1. Who we are and what these terms cover

Fictorial is a service run by Great Unknown LLC, a Georgia limited liability company (“we,” “us”). These Terms of Use (“Terms”) govern your use of fictorial.app and the Fictorial app (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Service.

2. Eligibility and your account

You must be at least 18 years old to use Fictorial. You’re responsible for keeping the email address or Google account you sign in with secure, and for everything that happens under your account. Tell us promptly at ben@fictorial.app if you think someone else has accessed it. One person per account; please don’t share logins.

3. Your work stays yours

You keep all rights to the manuscripts, notes, and other material you upload or create in Fictorial (“Your Content”). We claim no ownership of it.

To run the Service, you give us a limited, non-exclusive, worldwide, royalty-free license to store, copy, process, and display Your Content, and to send portions of it to our AI service providers, only as needed to provide the Service to you. This license ends when you delete Your Content or your account, except for copies in backups that expire on their normal schedule and anything we must keep by law.

We do not use Your Content to train AI models, and our AI providers’ business terms do not allow them to use it for training either. See the Privacy Policy for details.

You confirm that you have the rights to upload Your Content and that doing so doesn’t break any law or anyone else’s rights.

4. What Fictorial is, and what it isn’t

Fictorial uses artificial intelligence to help you discuss and examine your own manuscript. Please understand that:

  • Fictorial doesn’t write your book. It won’t draft, rewrite, or generate prose for your manuscript. It helps you examine what you’ve written.
  • AI output can be wrong. Answers, summaries, quotes, and suggestions may be inaccurate, incomplete, or misattributed. Check anything that matters against your manuscript.
  • It is not professional advice. Fictorial is not a substitute for an editor, agent, lawyer, or other professional, and we make no promise about how your book will be received, published, or sold.
  • You make the decisions. You are solely responsible for what you change, keep, publish, or submit.
  • Contest and publisher rules are your responsibility. Some contests, publishers, and organizations restrict the use of AI tools. Check their rules before you use Fictorial on work you plan to submit.

5. Acceptable use

You agree not to:

  • upload material you don’t have the right to use;
  • use the Service for anything illegal, or to harass or harm anyone;
  • try to break, overload, probe, or get around the Service’s security, limits, or access controls;
  • scrape, copy, resell, or reverse-engineer the Service, or use it to build a competing product;
  • use automated tools to access the Service except as we allow; or
  • try to make the Service produce content that breaks our AI providers’ usage policies.

Dark, violent, or difficult subject matter in fiction is fine. This section is about how you use the Service, not what your book is about.

6. Free trial, subscription, and billing

New accounts get a free trial with usage limits we set and may change. No payment card is needed to start.

To keep using Fictorial past the trial, you’ll subscribe at the price shown at checkout (currently $20 per month, plus any applicable taxes). Subscriptions renew automatically each month until you cancel.

Who you pay. Purchases are sold and charged on our behalf by Link (Sold through Link, LLC, a Stripe company), which handles payment, tax, and receipts. Your card statement will show LINK.COM* FICTORIAL. By subscribing, you authorize Link to charge your payment method each billing period. Link’s purchase terms (link.com/terms (opens in a new tab)) also apply to your payment.

You can cancel any time from your account settings, or from your Link account at link.com. Cancellation takes effect at the end of your current billing period, and you keep access until then.

Refunds. If Fictorial isn’t for you, email us within 14 days of your first subscription payment and we’ll refund it in full. After that, we don’t refund partial months or unused time. We will always refund a charge made in error, such as a duplicate charge or one you didn’t authorize. If you live in the EU or UK, you also have a 14-day right to cancel and get a refund under Link’s terms. Link may handle refund requests made to it directly, under its own policy. We may issue a refund at our discretion; doing so once doesn’t oblige us to do it again.

Founding-member pricing. If you start a paid subscription by 11:59 p.m. Eastern Time on December 31, 2026, you lock in $20 per month for as long as your subscription stays continuously active. The locked price ends if you cancel (including if your subscription is cancelled because you closed your Link account or asked Link to delete your data), or if a failed payment isn’t fixed within 14 days; if you resubscribe later, the then-current price applies. The locked price covers the subscription plan as it exists; add-ons, such as Revision Packs, and any new plans we introduce are priced separately. It is personal to your account and can’t be transferred. It does not limit our right to change features (Section 7) or discontinue the Service (Section 8).

Revision Packs. Subscribers can buy a Revision Pack, a one-time purchase that adds Workshop replies and manuscript uploads at the price shown at purchase (currently $10 for 100 replies and 2 uploads). Pack credits are used only after your monthly allowance runs out. Unused pack credits carry over while your subscription stays active. Pack credits can’t be used while your subscription is inactive, and return if you resubscribe. Revision Packs are non-refundable once any of their credits have been used, except where the law requires otherwise.

Apart from founding-member pricing, we may change prices for new and existing subscribers. We’ll give you at least 30 days’ notice by email before a new price applies to you, and you can cancel before it takes effect.

We may also change the plan’s monthly allowance of Workshop replies and manuscript uploads, including for founding members. We’ll give you at least 30 days’ notice by email before a change applies to you.

Subscriptions may include fair-use limits to keep the Service affordable. If your usage is far outside normal patterns, we may contact you or limit usage.

7. Changes to the Service

Fictorial is a young product. We may add, change, or remove features at any time. We’ll try to give notice of significant changes, but we can’t promise every feature will stay.

8. Suspension and termination

You can close your account at any time. We may suspend or close your account if you break these Terms, don’t pay, or create risk or legal exposure for us or others. We may also discontinue the Service entirely; if we do, we’ll give you at least 30 days’ notice where we reasonably can so you can export your notes, we’ll cancel your subscription so you aren’t charged again, and we’ll refund any Revision Pack you haven’t used.

If your free trial ends or your subscription becomes inactive, we keep Your Content for at least 90 days, so you can export it, or subscribe again and pick up where you left off. After that, we may delete it.

After your account closes, we delete Your Content as described in the Privacy Policy. Sections 3 (the parts about your rights), 4, and 9 through 13 survive termination.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We don’t guarantee the Service will be uninterrupted, error-free, or secure, or that AI output will be accurate. Keep your own copy of your manuscript. Fictorial is not a backup service.

10. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, GREAT UNKNOWN LLC AND ITS MEMBERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $50.

Some places don’t allow certain of these limits, so some may not apply to you.

11. Indemnity

If someone brings a claim against us because of Your Content or your breach of these Terms, you agree to cover our reasonable costs of dealing with it, including legal fees.

12. Disputes

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. Before filing any claim, please email us at ben@fictorial.app and give us 30 days to try to resolve it informally. Any dispute that isn’t resolved that way will be brought only in the state or federal courts located in Fulton County, Georgia, and you and we consent to those courts. Either party may bring a claim in small-claims court instead if it qualifies.

13. Other terms

If we update these Terms, we’ll post the new version with a new effective date and, for material changes, notify you by email or in the app at least 14 days before they apply. Continuing to use Fictorial after that means you accept the update. These Terms and the Privacy Policy are the whole agreement between us; Link’s purchase terms govern the payment itself. If any part is found unenforceable, the rest still applies. Not enforcing a term isn’t a waiver of it. You can’t transfer your account or these Terms; we may transfer them as part of a sale or reorganization of the business.
